Women’s political rights have been a pressing issue in the contemporary world especially after universal suffrage became an inevitable distinction of modern polity. In this paper political rights are not peculiar to polity in its narrow sense, rather it discusses women’s presence and role in public life as whole and more particularly from Islamic perspective. This study is confined to legal and Shari’ah framework in terms of permissibility and impermissibility of women to participate in public sphere. The study investigates and examines the religious teachings from its original scriptures and their historical and contextual interpretations throughout the history including classical as well as modern literature. The study reviews interpretations and explanations of the Quranic verses and the Prophetic traditions. The differences are highlighted between original and scriptural discourse and historical and temporal thought. This paper employs qualitative study by collecting primary sources through library research. Then content analysis is applied to the interpretations from Islamic jurisprudence literature and historical works to analyze views of scholars and to identify those grounds and evidences of the opinions which belong to the fundamental sources of Shariah; the Quran and the Sunnah. Amongst the findings are, that there is a huge difference between immutable teachings and Islam and its principles and historical and human interpretations of the latter two. Historical and Human interpretations are subject to scrutiny. Islam opens up broad role for women in public sphere in general as well as in politics in particular which they should not be deprived of.

The Research article highlights the issue of women and religious reforms and in contemporary Hinduism and focuses on one of the women dominated contemporary Hindu religious reform movements as a phenomenon of reviving the role of women as religious and spiritual leaders in Hinduism. The study is basically analytical in nature as the researchers have provided an analysis of the religious ideology and historical background of the leader of the ‘Brahma Kumari organization’ and then an Islamic appraisal for these ideas. The purpose of the research is to analyze the phenomena of contemporary socio religious reforms and the way these have upheld the status of Hindu women with an Islamic viewpoint. The article starts with an introduction of the issue and provides a brief account of the life history of Dada Lekhraj the founder. Then there is a detailed analysis of his religious and reformist ideas and that how it presented its ideology in the light of religion and how this organization has interpreted some key concepts of Hinduism. Finally, it is concluded that the movement of Brahma Kumari is a religious, spiritual and social reform organization and is a living example of religious leadership of women in contemporary Hinduism. The reform that is triggered by this movement has also some connotation with the role of women and some Islamic social ideals while its own particular religious traits demark it from the contemporary feminist ideologies.

The Muslim world is lagging behind in the theoretical conviction about the legality or illegality of Intellectual Property Rights and is, thus, failing to contribute to the growing developments in the field and their corresponding underlying concepts. Today, in the developed world, IP has gained increased protection with advances in technology and international trade. To protect the violation of IPRs, most countries of the world signed the agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) in 1994, administered by the World Trade Organization (WTO). The Islamic world continues to be part of this illegal activity with some claiming that” such rights are un-Islamic”, this study aims to answer this question in the light of the ruling issued by the Federal Shariat court. The Federal Shariat Court invited comments of the public about the Trade Marks Act, 1940 and twenty-two other Acts. The Ulema did not respond to the notice, therefore, the Court proceeded to examine the law on its own. This study aims to analyze the recommendations made by the Federal Shariat Court in this regard. It is imperative that Muslims internalize concepts of IP so that they can participate in and carve out a share in this enormous source of wealth. The major aim of this study is to highlight for the Muslim scholars, scientists and intellectuals, the current state of analysis by the FSC for validating intellectual property rights.

Jurisprudence of the Federal Shariat Court on Employer-Employee Relationship: A Critical AnalysisAuthor/s
Muhammad Umar KhanDoctoral Candidate, Faculty of Sharī‘ah & Law, International IslamicUniversity, Islamabad.Abstract
The Federal Shariat Court (FSC) Pakistan, as a constitutional court, has contributed towards the Islamization of laws, though, employment laws have not yet attracted its due attention for certain reasons. Flexible nature of employer-employee contractual relationship in Sharī‘ah, customary market practices, lack of workers’ awareness regarding their rights, long-lasting court proceedings and restricted jurisdiction of the FSC have compelled workers hesitate to opt for litigation. In fact, there have been found some fruitful employment relations laws but, in practice, there still have been found malpractices and exploitative misconducts that have been inherited from the British colonial era. Such practices include; Peshgī (obtaining debt in cash or kind in advance for future employment), jamadārī (supervisory body to ensure and monitor employment of those who have taken Peshgī) and forced labour. The Islamic Ideology Council shall convince and motivate the law-makers to incorporate provisions in respect of some of the religious rights and practices that have not been given due attention in the existing employment regime for instance; ‘Iddat (waiting period) and monthly periods, breast feeding and proper arrangements for performing the five times prayers. This paper is meant to explore the FSC’s approach while examining and deciding questions of repugnancy and interpretation in respect of certain ambiguous provisions of major employment laws. A critical analysis of lacunas has also been undertaken in the light of general principles of Sharī‘ah.

Sardar MuhammadAssistant Professor, Department of HumanitiesCOMSATS University Islamabad (Abbottabad Campus), Abbottabad, KPK, PakistanAbstract
This article examines Constructed Dialogue as Conversational Involvement in the story of Musa (Moses) and Al-Khadir in Surah Al-Kahf (ayat 60-82) in the Holy Qur’an. It is a linguistic technique usually followed to analyze Conversational Narratives, where the whole body of story is developed through dialogues, and thus converting it into a drama. The storyteller performs the role of real character of story and the reported speech (usually different from the words of actual story) represents the central theme of narrative. The significance of Constructed Dialogue lies in its extensive application on stories from Greek language to Biblical and Qur’anic narratives. The Qur’anic story of Musa (Moses) and Al-Khadir is analyzed through reported speech (dialogues of Moses and Al-Khadir). To create conversational involvement, different features of constructed dialogue suggested by Deborah Tannen have been kept in view. These features include direct quotation in reported speech, exchange of dialogue, speaker’s thoughts, thoughts of listener, historical present verbs, repetition, deletion of the verb of saying and linking, use of second person singular (you or thou) etc. The study is concluded through substantiating the role of Constructed dialogue in the story of Moses and Al-Khadir in creating conversational involvement of storyteller and audience through showing involvement of characters like Moses and Al-Khadir.

Zakat is one of the pillars of Islam. Almighty Allah has outlined the eight recipients of Zakat in Surah At-Taubah, verse 60. These are the only people who qualify to receive Zakat. One of them is Al ‘Aamileena ‘Alaiha. It refers to the people who are appointed by the Head of the Islamic State to collect Zakat. However, the status of Al ‘Aamileena ‘Alaiha is debatable among the Muslim jurists, ‘Ulama and contemporary scholars. Some accept them to be eligible to receive Zakat, while others deny their eligibility to own Zakat money. This article deals with the distribution of Zakat to Al ‘Aamileena ‘Alaiha. Besides the literal explanation of the term, the article discusses the respective comments by the renowned scholars and survey methodology is also applied to the discourse for a comprehensive and authentic discretion. The research addresses the legal status of various practices at present and issues of the institutions that are involved in the collection of Zakat. Zakat is the major source of revenue needed to generate support for the nation’s widows, orphans and the poor. It also strengthens the Islamic community at large and it adds to society’s wealth and helps in the creation of a means of earning for the destitute and needy. Al ‘Aamileen has a significant role in the collection of Zakat from the society by social-religious organizations, Madaris, welfare organizations and other institutions. Therefore, a thorough jurisprudence and legal detail about Al ‘Aamileen is presented in the article so that Zakat collecting institutions can facilitate them well and avoid any misconduct in this concern.

Qur’an revealed on the last Prophet Mohammad (SAW). Allah (SWT) said in Qur’an that We revealed to you (Prophet Mohammad) the message that you may make clear to the people what was sent down to them and that they might give thought. This tradition of explanation started from Prophet Mohammad (SAW) and remains continue to this era and this is known as exegeses of Qur’an. A basic principle of exegeses of Qur’an is to explain the verses of Qur’an by its other verses. By exploratory study we see that this principle is very much differ from one scholar to other. Especially in subcontinent one makes a verse an elucidation of other in the light of hadiths (sayings of the Prophet Muhammad Sallallahu alayhi wa sallam) while other makes the same verse based on Arabic literature. In this way a massive literature came into being based on these differences. As a result, more than one explanation of same verse reported by different scholars. In this article same issue is discussed with some examples.

Hafiz Anas NazarAssistant ProfessorDepartment of Islamic Studies, The University of Lahore, Lahore, Pakistanemail:anas.nazar@ais.uol.edu.pkHafiz Hussain AzharAssistant ProfessorDepartment of Social Sciences, University of Veternity and Animal SciencesLahore, Lahore, PakistanAbstract
The Qur‘ān is the book of guidance and the best explanation of the Qur‘ān is the interpretation made by Allah Himself at different places in the Qur‘ān. The Prophet (peace be upon him) also explained and interpreted the verses of the Qur‘ān and he also taught the wisdom and knowledge of the Qur‘ān to his companions and they further asked the Prophet (peace be upon him) the description of several verses time to time. Hence, the most reliable interpretation of the Qur‘ān is the Sunnah of the Prophet (peace be upon him) and the lifestyle of the companions (Mathora). Therefore, if some part of the Qur‘ān seems difficult enough to understand and has no clue from Qur‘ān and Sunnah, then it is mandatory to turn to the explanation of the companions as they knew the time and context in which a particular verse was revealed and the ancient literature, culture, norms and perfect grammatical structure too. This article discusses the importance of the Quranic interpretation by the companions with in-depth research of its respective aspects. Arguments of the prominent scholars are included in the article to support the viewpoint. The article concludes itself with some summarized points of the whole discussion. Scholars of Quranic studies need to have a clear and distinct understanding of Quranic interpretations and the juristic statements of the companions. This article is highly worthwhile in this subject.

The Qur‘ān is the word of Allah, a complete treasure of various sciences. Scholars have endeavoured for its interpretation since the age of its descending. Several scholars have worked in this respect from various dimensions. Topic-wise interpretation is also a significant type among such kinds. This type of interpretation was begun from the early age of Quranic interpretation; however, this specific term was used in the later periods. If we explore the topic in detail, we find various types of topic wise Interpretation which have a great impact on the understanding of the Qur‘ān. This research paper elaborates the definitions, components, and multiple types of topic wise interpretation. Besides, discussing the distinct aspects of each type, the article provides substantial information about the significance and impacts of topic wise interpretation on the understanding of the Qur‘ān. With the comparative approach of research, the researcher presented an honest comparison between the topic wise interpretations of the earlier scholars and the modern trends. Although there are several objectives of this style of interpretation, however, its primary aim is to facilitate the interpretation and comprehension of the Qur‘ān. Scholars adopted different approaches to facilitate comprehension of the Qur‘ān. Some have interpreted the Qur‘ān by compiling verses on different topics and some have interpreted one topic that is referred in various places in the Qur‘ān. Some scholars have followed another approach in interpreting different topics of the Qur‘ān. Such research on Quranic studies will expand the exposure of the young researchers and it will also open up novel avenues of interpretation for the researchers.

The Qur’ān is a complete code of life for the entire humanity. Along with commandments and injunctions, Almighty Allah refers to various stories (Qasas) in the Qur’ān for guidance and to bring forth lives and occurrences of the previous Prophets and their nations. These Qasas include warnings, good news, the result of disobedience and the recompense of submission. The basic theme of this article is to narrate the objectives and significance of these Quranic Qasas along with outlining the difference between Quranic Qasas and the common-told stories, the reason for the repetition of Qasas, and the philosophy behind these Qasas. The article elaborates that these Qasas (stories) convey all about the precepts of Prophets, acceptance and denial of their massage with good or regretful consequences as per the attitude of their nation. The article is compiled with an analytical approach and it not only details the need and essentiality, benefits and outcomes of the Qasas but also outlines various types of Qasas and their content. All Qasas guide human beings with a distinctive pattern. Thus, each story mentioned in the Qur’ān has its exclusive significance. This article is a brilliant attempt to bring out the moral lessons of the Quranic Qasas and to inspire the researchers to study this aspect of the Qur’ān more deeply.

The share of GMOs (Genetically Modified Organism) is gradually increasing in market and companies responsible for genetic changes are pressurizing law-making bodies to make new laws for their copyrights, patent and trademarks to gain a high level of profit at national and international level. This situation is leading to severe control of companies over food items that may lead to a new type of food-slavery that may subvert world economic conditions. Rights of farmers and rights of living organisms are becoming at risk, therefore, some naturalists, NGOs and religious scholars are opposing such laws and are trying against biopiracy and natural rights of farmers and consumers relating to food, seed-saving and breeding. Islām has its own socio-economic system that assures to establish a balance between the rights of all stakeholders, therefore it is necessary to know about the legitimacy of copyrights, patents and trademarks regarding GMOs and limitations imposed by Shari’a while chalking out such laws. Animals and plants are used as food by living organisms, hence they assume a high level of importance in life and need uniform availability of food items for all living organisms around the globe. Such laws regarding books, business, scientific research, software etc. are accepted by modern Muslim jurists and institutions of collective Ijtihād, but it’s necessary to know that while these laws are implementable on GMOs or not? Moreover, it is necessary to analyse these laws to bring forth their benefits and harms to the society in the light of shari’a guidelines to minimize these harms and maximize their benefits.

There are five core objectives of Islam behind the Islamic teachings. Establishment of Peace has been the main goal of Muslim Ummah. Both internal and external peace processes are included in it. In order to maintain internal peace, Islam has issued orders for the protection of individual's life, property and honor. Islam has also prescribed punishments to offences for safeguard individual and society in the world. These prescribed punishments or Ḥudūd are fixed and neither can be increased, nor decreased. Judges, any political authority or the family of victim can't waive these punishments. The object of Islamic law is to control the commission of the offences to defend the rights and interest of the public and assure peace in the society. Punishment is the actual method to protect and safeguard society against crimes and is thus a social need. In this article, Hirābah (Docīty) has been discussed in the light of Hanafī and Zāhirī Jurists' views. First part is about Hanafīs' views and the second part is about Hafiz Ibn Hazm al- Zāhirī's views regarding Hirābah (Docīty). Exclusive rights which are free from ownership are termed as usufruct. With regards to usufruct being wealth, the central theme of the opinions of the jurists is that those things of usufruct that have no connection with matters that are exclusively riches in nature and are stipulated based on benefit or harm as the right of a wife for her turn with the husband spending the night with her are not unanimously compared as wealth. However, those rights that are stipulated and have a connection with things that are exclusively wealth such as equitable (water stream) rights, drinking (field watering) rights, sewer system rights, pre-emption rights, demarcation rights, student rights, authority rights, publishing rights, trade name, trademark, invention rights, trading license, in the teaching of the majority i.e. the three imams and contemporary/latter-day Aḥnaf, they are in the ruling of being wealth. Whereas, according to the earlier Aḥnaf, these rights are not in the ruling of wealth. The article deals with this discussion comprehensively. Various arguments are presented with details and keeping the lexical requirements and contemporary issues in view, a conclusion is presented at the end.

Healthy food is required for healthy life. When industrialization of food began, issues related to food safety and security raised. To overcome these issues, different standards were developed for assuring the food security on individual, national and international level. One of these is HACCP (Hazard Analysis Critical Control Point], internationally established standard, which is made to avoid the hazard by applying a control system while preparation of food. In this way, the consumer gets safe and healthy food. HACCP is considered to be the most reliable food safety standard. As the demand of ḥalal is intensively increasing day by day not only by Muslim population only but by non-Muslims too considering ḥalal more hygienic and safer, it is the dire need of time to establish a ḥalal HACCP. A Model of ḥalal HACCP has also been introduced. This article, based on qualitative research methodology, implying critical and comparative styles, explores a brief introduction of both types of HACCP at first and their critical comparison at second. Authors have struggled to present the extract of their efforts after attending workshops, seminars meeting with professionals and studying the relevant literature. This study concludes that inclusion of ḥalal points in HACCP will surely upgrade its safety level for making food more hygienic and safer. This writing brings its fruit by providing recommendations to uplift the food safety level in our society.

This article analyses, compares and traces the common ethical values in the divine religions (Judaism, Christianity and Islam) to develop interfaith and social harmony among their followers in a pluralistic society. Social behaviour, relations and affairs are mostly based on moral values. In fact all divine religions have uniform ethical values due to having same origin and fountainhead. All divine religions comprise of three heads, beliefs, ethics and shariah. The first two heads belief and ethics are same in all divine religions whereas the shariah varies according to the demands of time, space, age and the nations. The present move towards globalization demands to establish interfaith and social harmony on the basis of common terms and ethical values. It will pave the way to make foriegn policies friendly and provide an environment to establish peaceful relations among the internationation communities. It will enable us to eradicate abhor, discriminations, differences and chaos based on race, color, religion, language and nationality, from the pluralistic society. The Quran also directs the Muslims to establish relations with the followers of the divine scriptures on the basis of common terms (Al-Quran 3:64). Pakistan is agricultural land. A country’s entire economy, employment and social behaviour are interrelated with its agriculture. Feudalism and landlord system is a big barrier in the expansion of agriculture industries in Pakistan. Therefore, people pleaded to abolish feudal and the landlord system for the agricultural reforms as India amended its constitution. It was a step to raise voice for a concrete solution that can lead to a welfare state. However, Qazliobash Waqf vs Chief Land Commissioner PLD 1990 SC 99 reversed the agricultural reforms. The article deals with the debate began after this decision that can a landlord legitimately own these estates? With numerous legal references and historical citations, the article presents a comprehensive discourse on the status of the landlords to own the land according to the precepts of Sharī’ah. This research study concludes itself with a discretion that the real property belongs to Almighty Allah. The Islamic State is the custodian of Bait ul Māl. Thus, the Government of Pakistan holds the right that under article 253 of the constitution, parliament can set the maximum number of properties for each type of property. In addition to this, a few suggestions (with valid legal basis) are outlined at the end for the benefit of the state and the pheasants. Agricultural reforms will surely change the destiny of our homeland and the nation will out of many of the present adversities.

Water is the greatest blessing of Allah Almighty and the basic necessity of life. Islam directs us to show complete responsibility in using water. Believers are reminded of this blessing in the Qur‘ān from various aspects. The Prophet (peace be upon him) also prohibited wasting water. We are enjoined to be careful even while performing ablution. Naturally, Allah will hold extravagant people who waste water, accountable on the Day of Judgment. Scarcity of water has become a severe concern of the world. This article deals with the teachings of the Qur‘ān and Prophet Muhammad (peace be upon him) regarding the responsible use of water. The research study elaborates the ways to preserve water in the form of lakes, canals and rivers. The water from these reservoirs is used in cultivation and other use. Allah loves purity and dislikes impurities and filthiness. Therefore, we are commanded not to use dirty water for any sacred purpose. The paper includes a discourse on the types of water to be used for cleanliness purposes. Preservation of water is the responsibility of every individual of the society. Unfortunately, in our society, least care is given to this issue, it is the reason that people are facing extreme shortages of water and if we do not realize it today and if we do not initiate measures for preservation, it would be very difficult for the masses to find pure drinking water enough for their daily use. Rather, as a Muslim, we should be grateful to Allah Almighty for such a blessing and show our responsibility religiously.

The Muslims, throughout the history, remained distinctive with two basic sciences in documenting and theoretical creativity, which are the science of the terms and the origins of the hadith, and the science of the principles of Islamic jurisprudence. The first belongs to screen the hadith via the critics of narrators or content and identify the correct, good, weak, and fabricated from the Ahādīth of Prophet (ﷺ). The second is to setup the curricula of deduction and diligence to lead the legal ruling of Islamic Shariah in correct way. The science of Principles of Islamic Jurisprudence is connected to Prophet (ﷺ)’s time, the rules were transmitted to the subordinates of Prophet (ﷺ)’s companions and composed in later stage. These principles reflect different methodology of theology and juristprudence. Hence the purpose of this study is to clarify the methodology of the relevant books so that the correct understanding of the principles of jurisprudence is possible for the students, at the same it will be easy to understand why some principles were accepted in one school of thought and the same were rejected among others.

In this article, it has been endeavoured to analyze the usage of synonyms in the Qur’ān, their logic and reasons. When we read the Qur’ānic words, there seems no any synonymical word but when we focuss deeply, we find numberless words which have the similar meanings clearly or metaphorically in the Qur’ān. In the Quran, each word has a specific meaning in its usage. As for the terminology, it is metaphorically given to several metaphorical uses, the most famous of which is the modesty of philologists in relying on two or more words that share the meaning of one, because the words may coincide with the one meaning or the one nominal, just as the two riders are synonymous with one animal. Based on this, the relationship in this metaphorical usage is similarity. What a Muslim should know is that there is no synonym in the words of Allah Almighty, according to the correct sayings of scholars, and a word does not sing about a word in it. In the Qur’ān, there are many places, where the synonyms are used for different causes, benefits and purposes.

The honorable Hadith is not like any other text in any book, as it is an encyclopedic and not specialized in one aspect of life. It tackles different aspects of material and spiritual life and even deals with what is after death and through that aspect, it sheds light on the future of man after death. Therefore, the Hadith is not limited by regulations put by scholars in the style of deletion in linguistics, but the deletion was suitable with the occasions and circumstances of the Hadith whether as a correction of something, warning or bringing good tidings etc. The aim of the study is to highlight the three types of deletion – letter, word, and sentence(s) in one text of the Hadith come together in addition to the cohesion of evidences and denotations that refer to the deletion with the accumulation of images. It makes the meaning clearer in order to promote the absent to the rank of the tangible. The deletion of one element from the sentence elements or part of the text aims to draw the attention of audience and readers. The article applies descriptive and applied method for the research.
